I always thought copyright meant something. I thought it meant that if it was yours you had control over it. If it wasn't yours you were not allowed to use it in any way shape or form that would either allow you to profit from it or reduce the profit of the copyright owner. As I understand, the copyright symbol doesn't even have to appear at the bottom of your work. If it is your original work, it is automatically copyrighted by law. Now, I realize this is simplified to the Nth degree but it really is a simple concept. So why don't some people understand or abide by it. I have contacted this person twice to tell her to cease and desist trying to profit from my work and she is ignoring me. She has for sale, on Blujay, my Baby Love Bib. She is asking $4.00 each and is offering to knit it in whatever colour you want. I have lost track of the number of times I tried to contact Blujay Administration and I never heard from them either. I finally received this message: "The Owner of blujay has left this site unattended. He does not answer emails. I am so sorry to tell you this. Anyone can list items here for sale and if you have any complaints your emails will go unanswered. Blujay is not taken care of. Sorry!"
When I complained in the community forum at Blujay the impotent, gutless wonder of a moderator told me this: "Administration is the only one who can remove an ad or store. They sometimes are not real prompt in taking care of things, especially when it may involve a gray area of law.
If I am reading this correctly you may not legally have a right to a product produced by a pattern that you are giving away for free, but I am not a copyright attorney. What is clear is that you own the pattern and someone else cannot sell your pattern. Work produced from your free pattern is the gray area that you may have to check with an attorney about. You haven't specified any restrictions in your ad on the secondary market except that the pattern is copyrighted.

WTF! Is she trying to tell me that because I generously gave out my pattern for free I only get a half a copyright on it?
Just in case, you may have noticed I am now specifying restrictions along with the copyright notice.
Needless to say, I will be moving my listings over to Etsy ASAP and canceling my Blujay account.
