And Justice Was Served!

I hope you all remember the situation we had with Dakota. In short, he came forward to tell us he had been molested at the babysitters. People who were supposed to be my best friends. This started back in May of last year. The court system is ridiculous. Delays upon delays, mainly coming from the defense side of course.
December 17th there was a final case review hearing. At this, the defendant is offered a plea bargain. Well lo and behold the scumbag took the plea bargain. Here are the details of his punishment.
Minimum 6 years in prison. He has to complete a program while in prison. I guess it's there form of 'rehabilitation'. If he doesn't complete the program, his sentence goes up to 15 years.
Upon release from jail, he will have one year of level 4 home confinement. He will have to wear an ankle monitor. He can be out of his home for 2 hours a day within a set boundary.
After that one year he will have 31 years probation! No contact with any minor under the age of 18.
As the social worker told me, the probation officers are no joke. This low life will not have an easy life once he is released. Constant monitoring, adhering to rules, etc.
If he tries to contact Dakota either by himself or through another person, we are to call the state police immediately.
When I got the news I immediately told Dakota. I told him, you will not have to testify in court. I also told him how proud I am of him. For coming forward and telling me and also for agreeing to see this through to the end. I told him, think of the other kids you have saved from the same abuse, you are my hero!
I had to get a little aggressive with the prosecutor's office. I had not heard anything about the hearing in December and the social worker was not returning ANY of my calls. So earlier this week I asked to speak to the prosecutor handling this case. I was put through to his secretary. I explained the situation and she was very angry that no one had contacted me nor returned any of my calls. She was able to tell me the guy took the plea bargain but could not access the records. She told me she would have to put me through to the social worker but if that woman did not call me back, I should call the secretary back the following day. Within 20 minutes of leaving a message, the social worker called me back. She had excuses, she wasn't at work on the day of the hearing. I said, well what about the messages I have left you asking for an update? Total silence on her end.
I am just glad I can close the chapter on this event. I think the probation officers will be the least of his worries once he is released. He will have this mama bear constantly watching his every move. And don't get me started on his enabling family who told everyone I made this whole story up!
Dakota is doing much better mentally. The psychologist who has been helping him is just awesome! I will ask her opinion about continued counseling, maybe on a less frequent basis.
In my opinion, child molesters cannot be rehabilitated! This was his second offense. He is now a tier 3 sex offender, meaning high risk! I don't know what the answer is, but we must do something to protect our children better.

I don't think they can be rehabbed either, sadly. I AM SO GLAD that this loser is behind bars! And so true what you told Kota about saving other kids from going through what he did. What a trooper.

I am so sorry that Dakota went through this, but very very proud of him for speaking up and for all of you for putting this molester away, far far away from society and especially from children. ((((HUGS))))

thank you! it was a difficult journey but a happy ending for us. I think Dakota can start fully healing now that he doesn't have this constantly in the back of his mind.

They should put him in prison and throw away the key--hopefully he will suffer for what he did to Dakota and chances are since child molesters are on the bottom of the food chain in prison he will!!!

that is what i am hoping for Martin. It might sound evil, but I hope he gets his just desserts. Plus he is a good looking guy, double whammy! If only I knew someone on the inside! There is a special place in hell for this scum and he will be living it right here on earth! dakota is an amazing boy, there were times I was so worried for him, I would just cry for the innocence stolen from him. But I will always have his back.

It's more than your opinion that child molesters cannot be rehabilitated. For all practical purposes, the guy will be monitored for the rest of his life for that reason.

I was checking into the different levels of probation and he will be one of the highest levels. A check in DAILY for an hour, whether it be with his probation officer of through counseling. He did counseling before and obviously that didn't help one bit.

I was horrified about dakota having to take the stand tell the court what happened. It was hard enough for him to tell me. I will never forget sitting in my bedroom, dakota with a blanket over his face. He felt very ashamed. I constantly reassured him that he did nothing wrong! that he was the victim of sick individual. I love this boy so much!

I am so glad there has been a resolution. Dakota can be so proud. Besides making himself safe, he helped to make sure this jerk would never do anything like this again to someone else! Go, Dakota!

it was very rough on him throughout this whole ordeal. there were days in the beginning he just could not go to school, nightmares mainly being the cause. He seems to be doing so much better now.

If someone in the prosecutor's office doesn't return calls or is otherwise unresponsive, I would go directly to the head of the office and advise him so that he is aware of it. Even now, after the fact, it wouldn't be a bad idea if you haven't already done it. That kind of person needs to be working somewhere else (McDonalds or 7-11, for instance).

I will take care of that. It was extremely frustrating in my case as I was only trying to do what was best for my son. I felt like I was just another case to them. I had planned on writing a letter as I feel if you have something in writing, it doesn't go away as quickly as if I simply call.

The mongrel deserves every thing he gets, here in south austalia a royal commission into crimes of this sort has started investigating crimes like these, even churches are being called over allegations made against them about abuse

it is an epidemic here, every day you see multiple people being arrested for this type of crime. Let me tell you, there were a few times I had a much simpler solution to this particular problem. No one would ever find the body!
