People Ignore Fireworks Ban; Burn Down Restaurant

There is an extremely wealthy family in the town where we lived for twenty years. About a week ago, a member of their family married; and the family rented an exclusive restaurant and club east of the city for the dinner and reception.

At some point, the family had contacted a company to provide a fireworks extravaganza. The company had followed the protocol getting a permit from the proper authorities to provide the fireworks show.

However, due to the drought in that area, a fire ban was in effect. In fact, the city cancelled its fireworks display held each year on July 4th.

The company went forth with its fireworks at the wedding nonetheless. Sparks set several small grass fires. The fire department was called and thought the fire was out.

Everyone left, the fire re-ignited, spread to the building, blew up a propane tank, and the building was destroyed.

Now, all interested parties, including the fire department, are pointing fingers at the next person. So, who do you think is a fault here--the family, the fireworks company, or the fire department?

The family for stupidly doing this in spite of drought, the Fire Dept for
not treating the display as a controlled burn and having trucks present.

The fireworks company... they are supposed to call at the start and conclusion of an event even when a permit was issued, and a ban set after the permit was issued nullifies the permit. (Permits presume no dangerous conditions exist. A drought is a dangerous condition.) That is just my opinion... drawing upon my years as an insurance adjuster.

Well, we are thinking that the permit was probably issued some time ago. However the fire chief also wanted to know WHO signed the permit.

If the fire department didn't cancel the permit, it's all their fault. Usually burn permits require the fireworks company to call the fire dept at the beginning and end of the event, and it's the fire department's job to say 'sorry, conditions aren't right, you must cancel.' But the event proceeded, and the fire dept came and thought they'd extinguished the fires. However, it is difficult to sue a government agency, so the building owner will probably sue all the parties to see what sticks.
