When is a Child an Adult? Our Criminal System



Teah Wimberly,
15 years old, killed a school mate because she rejected Teah's advances, was tried as an adult and has been sentenced to 5 years in
juvenile treatment center followed by 4 years in a youth offender
facility and then 16 years in adult state prison followed by 20 years
probation. She may become a 'free' woman when she is 40 but who/what
will she be?



At the age of 12 Lionel Tate was arrested for
killing a 6 year old girl that he supposedly was showing wrestling
holds he saw on television.  From that moment on his life was over
though more than one person came to his side and tried to help him. At
the age of 14 he was sentenced to life in prison for first degree
murder. He was released from prison 5 years later, was sponsored by a
church group. He is now back in prison. Please google his name for the whole story.



Five kids? Children? Teenagers? of which 4
were 15 years old and 1 was 13 years old conspired to pour gasoline over
15 year old Michael Brewer and torched him for $40 he supposedly owed
them. He is recovering pretty quickly despite most of his body being
burned. Will the  5 be tried as juveniles or as adults? Yes, adults.



Wayne Tracy, 15 years old, found his brother
hanging from a tree committing suicide. Two weeks later after, allegedly,
getting a text message from Josie Lou Ratley making fun of his
brother Wayne put on steel toed boots went to her school, was helped in
finding her by a 13 year old girl, and stomped Josie into a coma,
leaving her with brain damage. He will be tried as an adult and in all
probability will receive a life sentence. Does he need a life sentence
or serious help? Why wasn't he immediately counselled after finding his
brother?

We
live in a throw away society and there is no doubt the 8 kids plus the
4  victims, dead or alive, have been/will be thrown away. Does it matterr who is to blame?

I do believe
there are 'bad seeds'--people born evil, have no concious, may or may not know
right from wrong but will commit crimes without thinking twice but that
is not the purpose of thsi blog. It is to find out when a
child is an adult.

A child can
get a pilot's license at 15 in some States and in some States they can
get a car drivers learning permit at 14--are they kids or adults? Can a
kid not drink until he is 21 and an adult vote at 18?

If a child commits
murder at 14 is he a child or an adult? Are some 15 year olds children and some adults when
they commit murder? Why do some prosecutors want a 14 year old to be
tried as an adult while others will have them go to trial as a juvenile?
Who decides whether a teenage murderer is a juvenile or an adult? Is
there a test? Is it a let's see who can get bigger headlines? Is it our
throw away society who believes a kid cannot be redeemed? Why keep them
in prison for most if not all of their life? What do they expect a
teenager to become 20-30-40 years after being in prison? Should we leave
them any hope or dreams? Yes they destroyed their victims so is it an
eye for an eye?
